1. ACCEPTANCE OF YAHOO! TERMS
Yahoo! Games All-Star Package ("Yahoo! Games All-Star Package" or the "Service"), owned and operated by Yahoo! Inc. ("Yahoo!"), is a service through which registered Yahoo! Games users can access special rooms and to organize tournaments on Yahoo! Games. The Service is provided to you under the terms and conditions of these Yahoo! Games All-Star Package Terms of Service ("Additional Terms") that supplement the Yahoo! Terms of Service ("TOS") located at http://docs.yahoo.com/info/terms/ which is incorporated by reference. For clarity, Yahoo! Games All-Star Package is a "Service" as defined in the Yahoo! Terms of Service. Yahoo! reserves the right to update and change, from time to time, these Additional Terms and all documents incorporated by reference. You can always find the most recent version of these Additional Terms at http://games.yahoo.com/games/docs/tos.html and the most recent versions of the Yahoo! Terms of Service at the URL listed above.
2. YAHOO! ID AND YAHOO WALLET REQUIREMENT
To participate in the All-Star Package, you must have a valid Yahoo! ID. You must also have a Yahoo! Wallet, which will save your credit card, billing and shipping information and other information (your "Registration Data"). If you do not have a Yahoo! ID or a Yahoo! Wallet, you will be prompted to complete the registration process for them before you can pay for the All-Star Package. You agree that (a) the credit card number and other information you provide on Yahoo! Wallet is valid, accurate, current and complete and (b) to maintain and promptly update that information to keep it true, accurate, current and complete.
3. PAYMENT TERMS
The credit card that you provide as part of your Registration Data for Yahoo! Wallet will automatically and immediately be billed. All fees are non-refundable. All currency references are in U.S. dollars. Canadian residents will be billed in Canadian currency.
4. TERM AND TERMINATION
4.1. Payment for All-Star Package
Payment for All-Star Package occurs on a pre-pay basis and payment will be automatically renewed at the end of the term. Your billing term will depend upon which All-Star Package membership plan you choose. For example, if you choose the monthly plan, you will be billed every month on the anniversary date of your Registration. If you choose the three-month plan, you will be billed every three months on the anniversary date of your Registration. If you choose the yearly plan, you will be billed every year on the anniversary date of your Registration. Please note: If you have received a free offer for a specific number of days, then you will not be charged for the first time until after your free time period has ended. Subsequent billing dates will be on the anniversary date of your first billing date.
4.2 Cancellation for All-Star Package
You will have the ability to cancel your All-Star Package membership at any time. Any such cancellation will result in the automatic and immediate termination of your ability to access the Service. If you cancel your All-Star Package membership before the end of the term for which you paid, you will receive a partial refund based on the number of days between the anniversary date of your sign up for the Service and your cancellation date. We'll notify you via e-mail of your refund once we've received and processed your cancellation request. You can expect a refund in the same form of payment originally used for purchase within 7 to 14 business days of our receiving your cancellation request.
4.3 Termination
If (a) your credit card is invalid for any reason, (b) you charge back to your credit card the fees due under these Additional Terms, (c) it appears you have engaged in cheating or manipulation of the Service, or (d) Yahoo! otherwise believes you have acted inconsistently with the spirit or letter of the TOS or these Additional Terms, your All-Star Package account will be suspended or cancelled immediately and all the information contained within it will immediately become inaccessible.. Yahoo! may, but has no duty to, immediately terminate the Service if Yahoo! in its sole discretion concludes that you have provided false information in connection with your Yahoo! Wallet. Yahoo! accepts no liability for information that is deleted due to termination.
5. YAHOO'S RESERVATION OF RIGHTS
Yahoo! expressly reserves the right to immediately modify, suspend or terminate your account and refuse current or future use of any Yahoo! service, including the All-Star Package, if Yahoo!, in its sole discretion believes you have: (a) violated or tried to violate the rights of others; or (b) if we become aware of information indicating a safety concern for you, other Yahoo! Games users, or the general public, or (c) acted inconsistently with the spirit or letter of the TOS or these Additional Terms. The All-Star Package and its benefits are offered at the discretion of Yahoo!, and Yahoo! has the right to modify or discontinue, temporarily or permanently, the All-Star Package service, in whole or in part for any reason, at its sole discretion, with or without notice to you. You agree that Yahoo! will not be liable to you or any third party for any modifications or discontinuance of the All-Star Package service.
6. INVALIDITY OF SPECIFIC TERMS
If any provision of these additional terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the such documents remain in full force and effect.
7. LOCATION OF LAWSUIT
The Yahoo! Terms of Service, which apply to your All-Star Package provides that both you and Yahoo! agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California. The Yahoo! Terms of Service, these Additional Terms and the relationship between you and Yahoo! will be governed by the laws of the State of California, without regard to the conflicts of law provisions thereof.
